Privacy Policy

This Privacy Policy explains how Third Term Inc. ("Third Term Learning", "TTL", "we", "us" or "our") collects, uses, shares and protects personal information.

Third Term Learning is a creative eLearning company. We provide learning experience design, instructional design, graphic design and custom digital learning solutions to businesses.

This policy applies to personal information we receive through our website, www.thirdtermlearning.com, through LinkedIn Lead Gen Forms and our other advertising, and through business communications such as email, calls, meetings and events.

It does not cover personal information we process on behalf of our clients when delivering a project, such as learner data inside a client's learning platform. That processing is governed by our agreements with each client.

If you have any question about this policy, contact us at info@thirdtermlearning.com.

Information We Collect

We collect the personal information you choose to share with us and limited technical information about your use of our website.

  • Contact and professional details: name and surname, work email address, phone number, job title, company name, country, and other professional information requested in a form.
  • Information about your request: the content of your messages, details about your project or training needs, and the team member you ask to talk to.
  • Communication records: emails, meeting notes and other correspondence related to a business inquiry, proposal or relationship.
  • Marketing preferences: whether you agreed to receive marketing communications and any opt-out requests.
  • Technical and usage information: IP address, browser and device type, pages visited, referring page, and date and time of your visit, collected through cookies and similar technologies where these are in use.

We do not intentionally collect sensitive personal information, such as health data or government identification numbers. Please do not include it in forms or messages.

How We Collect Information

  • Directly from you, when you complete the contact form on our website, email us, call us, meet with us, or talk to our team at an event.
  • Through LinkedIn Lead Gen Forms, when you choose to submit one of our forms on LinkedIn.
  • Automatically, when you browse our website, through cookies and similar technologies.

How We Use Your Information

We use personal information to:

  • Respond to your inquiries and requests.
  • Provide information about our services, including proposals and quotes you request.
  • Follow up on a business inquiry or request for a proposal.
  • Assess and manage potential and existing business relationships.
  • Send relevant marketing communications, where the law allows it.
  • Understand how our website and campaigns perform, and improve our marketing and business development activities.
  • Keep our website and systems secure.
  • Comply with legal obligations and establish, exercise or defend legal claims.

We do not sell personal information, and we do not use it to make decisions about you based solely on automated processing.

LinkedIn Lead Gen Forms and Advertising

We advertise on LinkedIn and may use LinkedIn Lead Gen Forms. These forms let you request information from us without leaving LinkedIn.

What we receive. LinkedIn may pre-fill a form with information from your LinkedIn profile. You can review and edit it before you submit. We only receive the information you choose to submit in that form, which may include your name and surname, work email address, job title, company name and other professional information the form asks for. If you do not submit the form, we do not receive this information.

How we use it. We use the information submitted through a Lead Gen Form to:

  • Respond to your inquiry or request.
  • Provide information about Third Term Learning's services.
  • Follow up on your business inquiry or request for a proposal.
  • Assess whether there is a potential business opportunity.
  • Send you marketing communications, only where the law allows it and, where required, only with your consent.

The form itself may describe the specific purpose of your request. Submitting a form does not mean you agree to every type of marketing communication. Where a form includes a separate consent checkbox, we only use your information for marketing in the way that checkbox describes.

Roles. LinkedIn operates its platform, its forms and its advertising tools. LinkedIn's own handling of your information is described in the LinkedIn Privacy Policy. Once we receive your submission, our use of that information is governed by this Privacy Policy.

You can manage how LinkedIn uses your data for advertising in your LinkedIn advertising settings.

Legal Bases for Processing

Where data protection laws require a legal basis, such as the EU GDPR, the UK GDPR, Switzerland's Federal Act on Data Protection or Brazil's LGPD, we rely on:

  • Consent, for example when you submit a form and ask us to contact you, or agree to receive marketing. You can withdraw consent at any time.
  • Steps prior to a contract, when you ask us for a proposal or quote.
  • Legitimate interests, such as responding to business inquiries, managing business relationships, promoting our services to professionals, and keeping our systems secure. We only rely on this basis where our interests are not overridden by your rights.
  • Legal obligations, when we must keep or disclose information to comply with the law.

How We Share Information

We share personal information only when needed for the purposes in this policy:

  • Within our team, including commercial team members in different countries, so the right person can respond to your request.
  • With service providers that support our business, such as website hosting, email and analytics providers. They may only use your information to provide services to us.
  • With advertising platforms such as LinkedIn, to run and measure our campaigns.
  • With professional advisers, such as lawyers and accountants, under confidentiality obligations.
  • For legal reasons, when required by law, court order or a public authority, or to protect our rights, our users or others.

We do not sell or rent personal information to third parties.

Third-Party Services and Platforms

We use third-party services to run our website and business. Depending on the service, they may process personal information on our behalf or under their own privacy policies. These currently include:

  • Webflow, which hosts our website and processes submissions to our website contact form.
  • LinkedIn, for advertising, Lead Gen Forms and our company page.
  • Microsoft 365, for email and business communications.
  • Google Analytics, to understand how visitors use our website.

Our website links to third-party sites, such as our LinkedIn and Instagram pages. Their privacy practices are governed by their own policies, not this one.

International Data Transfers

Our team works across several countries, including the United States, Spain, Switzerland, Argentina and Brazil, and some of our service providers are based in other countries. Your information may therefore be accessed, stored or processed outside the country where you live, including in countries whose data protection laws differ from yours.

When we transfer personal information internationally, we use the safeguards required by applicable law, such as standard contractual clauses or transfers to countries recognized as providing adequate protection. You can contact us to request more information about these safeguards.

Data Retention

We keep personal information only for as long as we need it for the purposes described in this policy.

  • Inquiries and leads that do not become a business relationship: up to 24 months after our last contact.
  • Client and supplier records: for the duration of the relationship and afterwards for as long as required by tax, accounting or other legal obligations.
  • Marketing preferences and opt-outs: for as long as needed to respect your choices.

When information is no longer needed, we delete it or anonymize it.

Data Security

We use reasonable technical and organizational measures designed to protect personal information against loss, misuse, and unauthorized access, disclosure or alteration. These include limiting access to the people who need it and using service providers that apply their own security safeguards.

No method of transmission over the internet or of electronic storage is completely secure, so we cannot guarantee absolute security. If you believe your information has been compromised, contact us at info@thirdtermlearning.com.

Cookies and Website Analytics

Cookies are small files stored on your device when you visit a website. Our website uses:

  • Essential cookies, needed for the website to work and stay secure.
  • Analytics cookies, through Google Analytics, to understand how visitors use our website.
  • Advertising cookies, such as the LinkedIn Insight Tag, to measure the results of our LinkedIn campaigns and show relevant ads.

Where the law requires it, we ask for your consent before placing non-essential cookies. You can block or delete cookies in your browser settings. Blocking some cookies may affect how the website works.

Your Privacy Rights

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you.
  • Correct inaccurate or incomplete information.
  • Delete your information.
  • Object to or restrict certain processing, including for direct marketing.
  • Receive your information in a portable format.
  • Withdraw your consent at any time, without affecting processing carried out before.

To exercise these rights, email info@thirdtermlearning.com. We may need to verify your identity before acting on your request. We will respond within the time limits set by applicable law. We will not discriminate against you for exercising your rights.

European Union, United Kingdom and Switzerland

Under the GDPR, the UK GDPR and the Swiss Federal Act on Data Protection, you also have the right to lodge a complaint with your local data protection authority.

Brazil

Under the LGPD, you may also request confirmation that we process your data, information about the entities we share it with, and anonymization of unnecessary data. You may file a complaint with the National Data Protection Authority (ANPD).

United States

Residents of some US states, such as California, may have rights to know, delete and correct personal information, and to opt out of its sale, sharing for targeted advertising or profiling. We do not sell personal information. To exercise any right available to you, contact us by email.

Marketing Communications and Opt-Out

We may send you information about our services, case studies, events and content related to eLearning, but only where the law allows it. In some countries this requires your prior consent; in others, we may contact business professionals based on our legitimate interest, always with an easy way to opt out.

You can stop receiving marketing communications at any time by using the unsubscribe link in any marketing email or by writing to info@thirdtermlearning.com. We will still reply to messages related to a request you made or an existing business relationship.

Children's Privacy

Our website and services are intended for businesses and professionals. They are not directed at children, and we do not knowingly collect personal information from anyone under 18. If you believe a child has provided us with personal information, contact us and we will delete it.

Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our practices or in the law. The current version will always be available on this page, with its last updated date. If we make significant changes, we will take reasonable steps to let you know.
